Cybrid Canada User Terms
I. Cybrid Canada Services
If you make use of the services of Cybrid Canada then the terms of this “Cybrid Canada User Terms” shall apply, subject to the terms and conditions of the “User Agreement” available at: https://cybrid.xyz/legal/user-agreement.
The User Agreement shall govern (and its definitions shall have the same meaning here) unless there is a conflict with these Cybrid Canada Terms, in which case the Cybrid Canada Terms shall govern. The limitations of liability and other terms of the User Agreement shall apply to your use of the Cybrid Canada services. All references to “agreement” are to the combined terms of the User Agreement and Cybrid Canada Terms.
II. Regulated Services
Cybrid Canada is a regulated Money Services Business (M22090386). Cybrid Canada is also a Payment Services Provider under the Retail Payments Activities Act. Your transactions may be governed by the foregoing regulatory systems and you may have legal rights under these laws that supersede this agreement. Please also note that Cybrid Canada is not a bank or trust company.
If you experience an issue with Cybrid Canada in relation to a regulated service then you may write to us and we will work with you to promptly resolve the issue. You may also choose to file a complaint with the applicable regulator, but we encourage you to work with us by raising any issues directly, as we may be able to solve the problem more efficiently through direct discussion.
III. Routes For Your Transactions
Cybrid Canada shall have the right to select which combination of its own licensed/regulated services, service providers, and technological solutions are most efficient to achieve the transactions that you are conducting, but shall not have any liability for failing to select the most cost-effective route, as there may be unexpected factors that may impact the best choice of transaction route. Cybrid Canada regularly contracts with new service providers to ensure the best level of service for customers that it is able to obtain.
IV. Safeguarding Under The Retail Payments Activities Act
Assets are not necessarily covered by CDIC but funds in Cybrid Canada’s Payment Services Provider safeguarding account(s) are generally covered by CDIC insurance, up to the limits provided by CDIC and which you can learn more about at: https://www.cdic.ca/financial-professionals/payment-service-providers/.
V. Pre-Authorized Debits
If you provide information to us for a Pre-Authorized Debit (“PAD”) than you expressly acknowledge that we may draw on that account and that your provision of information for the PAD shall be your electronically signed authorization of the PAD.
VI. Choice Of Forum And Governing Law
The place for disputes shall be the courts of Toronto, Ontario, Canada unless prohibited by your local law, in which case the place for dispute resolution shall be the legally-mandated forum. The laws of the Province of Ontario shall govern any dispute between the parties.
